This action was commenced January 28, 1955 by Oscar Severin to recover from Benjamin Luchinske and Milwaukee Automobile Insurance
Company, Ltd., for injuries sustained on November 27, 1953 as the result of being struck by a truck operated by Luchinske.
It is alleged in the complaint, and not denied, that Severin and Luchinske were co-employees of the City of Wisconsin Rapids,
and that the defendant insurance company had issued to the city a policy of insurance, by which it agreed to pay any liability
incurred by the city on account of bodily injury and property damage by reason of the operation of the truck involved by the
city or anyone using it with its permission. It appears from the pleadings and the affidavits filed in support of and in opposition
to the insurance company's motion for summary judgment, that at the time of the accident Severin and Luchinske were performing
work in the course of their employment; that Severin had applied for and received benefits of the workmen's compensation act
from Hardware Mutual Casualty Company, also an insurer of the city; and that the latter company had assigned to the plaintiff
its interest in its claim against Luchinske and the Milwaukee Automobile Insurance Company, Ltd. The motion for summary judgment was denied by order entered on May 18, 1955. The Milwaukee Automobile Insurance Company appeals.
